I was browsing through the pages of Mathrubhumi weekly (Malayalam) and I was stumbled upon their book reviews section. The reason was a cover picture of one book that they had reviewed in their literary review section which resembled a photo that I took back in 2006 in Nileshwaram, Kasaragod district. I was curious because it looked like an exact copy of the picture that I had taken. The book was "Vettachekon Enna Theyyam", a collection of short stories written by Ambikasuthan Mangad and published by Prantha Books, Kochi.
I bought a copy of the book from D C Bookshop, Thrissur to examine the picture better. I realized that they had copied the picture from the photo that I had taken and uploaded in Flickr, but did not credit me. Then I collected the contact details of Pranatha Books and I called the owner of Pranatha Books named Mr. Shaji and talked to him over the phone. At first, he denied the charge and said the picture was taken by his photographer and even before I had mentioned he asked me if my photo was published in the Internet. When I said yes, he said he would call me back and after a while he called back and admitted that his photographer had copied the image from the Internet. However, he was not ready to agree that the original source was credited to me.
I had set the following copyright information for my photo with a Creative Commons (India) License. It says:You are free to share under the following conditions:
Attribution. You must attribute the work in the manner specified by the author or licensor (but not in any way that suggests that they endorse you or your use of the work).
Noncommercial. You may not use this work for commercial purposes.
No Derivative Works. You may not alter, transform, or build upon this work.
Evidently, what his publishing house did was an open violation of copyright. He said he would call me back after confirming, but that never happened. Then I sent a registered post with acknowledgment due to Pranatha Books. I also sent the contents of this letter through an e-mail. In the letter, I had mentioned the following:1) Pay me royalty in respect of the number of books published and sold, or a lumpsum amount, which we can mutually arrive at.
2) In subsequent editions, I need proper credit given to me for the cover photo
3) A press release acknowledging my copyright over the photograph
I had also mentioned,Be warned that if I do not hear from you within a week from the date of your receiving this, I will be constrained to initiate legal action against you at your cost, consequences and risk.
Unfortunately there has been no reply for my registered post mail so far (I sent the registered mail on February 27th, 2008 and now it has been over a month). I don't know why Prantha Books is not responding but I want them to know that I am not going easy on this and the matter does not end with this blog post. A legal notice will be issued in their name and I am all prepared to take it to the court unless they opt for a proper settlement.
My image on Flickr: (I took this photo in 2006 while I was staying in my friend and photoblogger Thulasi's house to see Theyyam for two days in his village Kakkad, at Nileshwaram, in Kasaragod district, in Kerala)
Now the cover page of the book: (evidently they photoshopped the background and put the face in half)
PS: It has now become a practice that the publishing houses/corporations misuse images from Internet for commercial purposes without any proper credit or compensation. Earlier, fellow Blogbhartian Mridula had a similar issue. She got a measly compensation and they did run a correction where they squarely named the freelancer and said they took the photo without permission. In her case it was a magazine.

I am so glad you are taking the legal route. You have all my support.
We all are here to support you Joe. Never give up on this. This is very bad and they should not do this. They didn't even give credits and that is very un-professional.
Please keep us updated on this.
I wish you luck with this and hope that these publishing houses will learn not to do this.
Go after them. This is the reason not to upload photos on flickr. or other photo sharing domains. I read where a girl uploaded her photo on flickr, or one of the other ones, not sure. The next thing she knew her photo was stolen & it was featured on the cover of a porno movie cd! If I recall correctly, she was also underage when the photo was taken.
This may sound lil strange, but if you can, record the conversation you make over phone (with the editor, publisher etc). Should not be difficult with a speaker phone n pc. May be of help in future.
I am glad you stumbled upon the book and recognized the photo. I guess I would never be able to do so.
Go for the legal action, we all support you.
Looks like the same picture to me...
good luck with your fight... and i am glad you are taking this up rather than say "chalta hai "
Among media, the most blatant copyright violation happens with Economic Times. They haven't dared to flick images from Flickr, but 90% of the generic images are taken without paying a buck. They have even run images with Getty Images watermark on them!
Jo - Let me know if you need any help.
Let's fight together as Bloggers.
I remember - A popular website did the same with one of my Photos of a Freedom Fighter!
Of course you must get your due! You have all our good wishes!!
the support is unanimous for you Jo .... i hope like Madhvi kapoor in pune (who fought to sell her flat against societies discriminations to a different religious faith family) u'll also succeed against these attitudes.
Try:
http://cc-india.org/?q=node/3
Hope justice is granted to you.
Jo - Not only is this unprofessional but downright cheap on the part of the publisher to steal!!!!!!
Do Prantha Books steal as a rule?
Jo, consider making this post sticky. I think that helped in my case. I also kept mailing the updates to the editor!
>> Mridula: Thanks a lot for all your help and support Mridula. I will make this a sticky post for sometime and will send the updates to the publisher as you advised.
>> Din: Thanks Din, will post updates here and yeah, I will record the calls from them or would
rather ask them to send email or postal mail.
>> Cindy: Thank you for your support Cindy.
>> Anonymous: That's a terrible incident that you mentioned. I usually am cautious about posting the photos of womenfolk to Internet. The photos in my Flickr account are taken with enthusiasm in photography.
>> Cuckoo: I was really shocked to see it and I realized it when I bought a copy of the book. Yes, am planning for the legal action.
>> Marsha: Oh yeah!
>> Harini: Thank you Harini. What makes me want to go the legal way is that they did not even bother to respond to my postal mail/email.
>> Narayanan Venkitu: Thank you for the support! An action is needed so that they will think twice before stealing pictures without leaving proper credits.
>> Sudipta: Thank you Sudipta!
>> Ram N: Thanks Ram. Let's see what happens.
>> Gautam: Thanks for that link. I have written to the people who have been mentioned in that page.
>> Rishabh: Thanks Rishabh.
>> Anil: Thank you Anil. I don't know if they make it a practise. :-) Shall checkout with their other book covers too!
Thank you all for your kind words and support. I will post updates here as it happens. I also want to thank my dear friend and fellow blogger Rama Iyer for her help and legal advise in the matter.
Jo,
All my support to you regarding this matter.
Do not let this happen again and people take copyright especially from internet as such a light thing.
Dear Jo, its shocking news. u should take legal action accordingly. dont worry...
Jo,
Go ahead, we will be with you!
Jo,
All the very best for your struggle. And I agree that your creativity needs to be recognized and rewarded.
kind regards

With all support, Joe
Jo,
Your picture is a great one, and they have distorted the same and used it without your permission. You must fight it out, and all the best for your efforts.

Dear Jo
I urge you never to agree for an out of court settlment. Since this would undermine the need for creating a prcedent case.
The mallu media has taken copyright infringment too lightly and should be dealt with maximum force.
Thulasi had mentioned about this copying issue when we met in Nileswaram almost a month ago. since then i was wondering why you were not doing anything about it. am glad that you've brought this issue in public. i pity them and wish you all the very best in fighting this case
Jo, we are with you.
btw,
you were using Jo in first place and then changed it into Joe citing the feminine character of the former short form. Then what prompted you to revert? Was it that simple numerology queries that ended the game?
No. It was when my friend Velu convinced me that both Jo and Jo can be a short form for Joseph. There ended the game.
Surely sue the hell out of them and also let the rest of us know how to go about the legal procedings. Am sure many ppl dont go that way because the consider it a "hassle".
Sure, will post updates in this blog space.
Nandi Chandrettaa...
Go Ahead man..The thing is that they just don't care..teach them..
any update?

Officials from arbitration center will contact them to see if they are interested in settling the matter out of court. So far Pranatha has not responded to the legal notice.
This is really incredible. I have never heard of something so bizarre - I am fighting my own case with TIMES OF INDIA (story on my blog) but this is so outrageous and I really do wish you all the luck!
Hey Jo! Any update on this issue?
BTW, try tineye.com to find stolen images.
Hi there,
Have you tried zooming into the iris of the theyyam guy? I can vaguely make out a male figure. If it turns out to be you, then there's every chance you will get a clear hold of your slice of the pie, out of court or otherwise.
All d best

They agreed upon Rs. 1000. :-)
nice to hear that Jo !
